Wade and ruling there is no right to an abortion contained within the United States Constitution, President Joe Biden demanded that Congress throw out the Senate filibuster rule and pass legislation legalizing abortion.
If the Senate filibuster rule is cast aside to legalize abortion, the legislation could pass with 51 votes instead of 60.

“President Joe Biden said Thursday that he would back a filibuster carve-out in order to codify Roe v. Wade…
“‘The first and foremost thing we should do is make it clear how outrageous this decision was and how much it impacts not just on a women’s right to choose, which is a critical, critical piece, but on privacy generally,’ Biden said during a press conference in Spain, where he’s wrapping up the North Atlantic Treaty Organization (NATO) Summit. ‘But the most important thing, to be clear about it, I believe we have to codify Roe v. Wade in the law and the way to do that is to make sure Congress votes to do that.’” [emphasis added]
Biden then expanded his demand that the Senate filibuster rule be cast aside.
“And if the filibuster gets in the way, like voting rights, we provide an exception for this, we require an exception to the filibuster for this action to deal with the Supreme Court decision.” [emphasis added]
