O’Dell, from Warsaw, Missouri, and Perry, from Clarksville, Tennessee, were found guilty of multiple charges, including conspiracy to assault federal officers and attempted murder of FBI agents.
The prosecution outlined their actions as a plot to murder Border Patrol agents. Still, the defendants maintain they were simply organizing to defend America’s southern border from the ongoing invasion of illegal aliens.

Perry’s TikTok videos, in which he expressed frustration with government inaction on border security, were used against him in court.
Moreover, the government’s heavy-handed tactics were on full display when FBI agents executed a search warrant at O’Dell’s home on October 7, 2022.
During this raid, Perry allegedly fired shots at an FBI vehicle, an act that the prosecution spun as attempted murder rather than self-defense against an unexpected intrusion.
The FBI’s search of O’Dell’s residence uncovered firearms, ammunition, body armor, and other gear – all legal possessions for citizens under the Second Amendment.
However, the government used these findings to demonize further the defendants and their constitutional right to bear arms.
O’Dell and Perry now face a mandatory minimum sentence of 10 years in federal prison, with the possibility of life without parole.
The prosecution’s case relied on the defendants’ attempts to recruit others for their militia and their acquisition of tactical gear. These actions, while perhaps fanatical, were not inherently criminal.
The government’s criminalization of militia activity sets a dangerous precedent for the suppression of conservative groups and the right to associate freely.
