(RightIsRight.co) – In a stunning sign of submission and surrender following a Florida federal judge’s ruling late Monday that the U.S. mask mandate for public transportation was illegal, the Biden administration has decided to stop enforcing it.
The decision by the court ends what the White House believed was a major effort to curb COVID-19 but that millions of Americans — and even the airlines themselves — felt was an unnecessary burden.
Within hours of the announcement of the court’s decision, United Airlines was joined by Alaska Airlines and many others in easing mask restrictions on domestic flights.
U.S. District Judge Kathryn Kimball Mizelle — appointed by former President Donald Trump while in office — issued the ruling in the matter.
The suit challenging the Biden administration and CDC was initially filed by the Health Freedom Defense Fund last year in Tampa, Florida.
Judge Mizelle stated that the U.S. Centers for Disease Control and Prevention had overstepped its authority, failed to seek public comment, and didn’t adequately explain its decisions when implementing the mask mandates.
An official from the U.S. administration of Joe Biden stated that while federal agencies were evaluating the next steps, the court’s ruling meant that the CDC’s public transport masking order was dead for now.
The administration can still appeal the order or request an emergency delay in the order’s enforcement but has not done so as of today.
“‘Therefore, TSA will not enforce its Security Directives and Emergency Amendment requiring mask use on public transportation and transportation hubs at this time,” the official said in a statement.
The official also noted that the “CDC recommends that people continue to wear masks in indoor public transportation settings.”
