(RightIsRight.co) – Despite being deported twice, a 24-year-old illegal alien stands accused of brutally murdering his ex-girlfriend in Utah just days after illegally re-entering the country.
The return of such a person to the country raises questions about the government’s capability to enforce immigration laws.
Mexican Nestor Rocha-Aguayo was deported on December 24, 2024, but quickly made his way back into the U.S. illegally.
On January 1, 2025, he contacted his 31-year-old ex-girlfriend Talia Benward to pick him up, setting a chain of events in motion that would end in tragedy.
Surveillance footage captured the couple arguing in a car before traveling to a remote area of Tooele County, where Benward’s battered body was later discovered.
The gruesome details of the crime scene paint a horrific picture of Benward’s final moments. Police found her partially clothed body with extensive injuries, including signs of blunt force trauma and neck injuries.
Evidence of a burn pit with partially burned items matching those from Benward’s borrowed car was also uncovered nearby, suggesting a calculated attempt to destroy evidence.
Rocha-Aguayo’s criminal history in the U.S. is extensive and alarming. Prior to this alleged murder, he had been convicted of burglary, assault, and possession with intent to distribute a controlled substance.
Despite these offenses and multiple deportations, he continued to re-enter the country with apparent ease, highlighting the glaring weaknesses in our border security.
The suspect’s brazen disregard for U.S. law is further demonstrated by his attempts to flee justice.
After the murder, the man tried to escape police twice before being captured on a bus headed back to Mexico.
He now faces multiple serious charges, including aggravated murder, aggravated robbery, evidence tampering, and abuse or desecration of a dead body.
This tragic case serves as a stark reminder of the real-world consequences of lax border policies and the failure to vet and track individuals entering the country properly.
“It’s tragic, it’s horrific, there’s no excuse for it,” said Adam Crayk, who specializes in immigration and criminal law.
“The accused was deported previously, re-entered after a prior deportation, and then is now alleged to have committed homicide against his former, or his partner,” he added.
With Rocha-Aguayo held without bail, Utah’s justice system must act decisively to correct this grave injustice while reconsidering lax immigration policies.
This tragic occurrence underscores the urgent need to secure the borders firmly and effectively to prevent future tragedies that leave families broken and communities shocked.
